The self-proclaimed Jewish-American \u201cprogressive\u201d organization IfNotNow\u00a0hosted a discussion on Jan. 27 about \u201chow the\u00a0IHRA definition<\/a>\u00a0of anti-Semitism has been destroying the progressive movement.\u201d The word \u201cdiscussion,\u201d may, in fact, be too generous a term for what was, in reality, a diatribe of misinformation.<\/p>\n

An address by Taher Herzallah, associate\u00a0director of outreach and grassroots organizing for American Muslims for Palestine (AMP), took up much of the event.\u00a0It should be noted right away that AMP\u2019s platforms disseminate anti-Jewish propaganda. Articles on its website\u00a0complain<\/a>\u00a0about \u201cJews \u2026 illegally colonizing the occupied territories\u201d\u00a0and<\/a>\u00a0\u201cZionist Jews\u201d who have the gall to regard Jerusalem as the undivided capital of the Jewish state. Appallingly, a\u00a0video<\/a>\u00a0posted to AMP\u2019s Facebook page commemorating \u201cNakba Day\u201d falsely\u00a0presents<\/a>\u00a0a picture of Holocaust victims as Palestinian victims of Israeli violence (the picture in question is displayed at 1:25 in the\u00a0video<\/a>). IfNotNow has\u00a0partnered<\/a> with AMP in the past.<\/p>\n

Herzallah has hardly shied away from hatred himself. At a 2014 AMP conference, he reportedly\u00a0claimed<\/a>: \u201cIsraelis have to be bombed; they are a threat to the legitimacy of Palestine, and it is wrong to maintain the State of Israel.\u201d That\u00a0same year<\/a>, AMP hosted a fundraiser dinner in honor of\u00a0Rasmea Odeh, a convicted terrorist directly responsible for the deaths of two civilians in a 1969 grocery-store bombing in Jerusalem. IfNotNow may\u00a0purport<\/a>\u00a0to \u201cstand up for the freedom and dignity for all Israelis and Palestinians,\u201d but its embrace of AMP suggests otherwise.<\/p>\n

The rhetoric spouted by Herzallah during this event is of equal concern. He egregiously asserted that \u201cpeople like [him] \u2026 had to pay the price\u201d for the Holocaust\u2014an obvious attempt to appropriate the trauma of the victims of Nazi genocide on International Holocaust Remembrance Day, no less. He even dismissed the well-documented\u00a0alliance<\/a>\u00a0between \u201ccertain Palestinian leaders\u201d and the Nazi regime as part of a \u201cmyth\u201d before later insisting that \u201cwe want to question the existence of the State of Israel itself.\u201d This questioning, he urged, \u201cshould not be off the table.\u201d<\/p>\n

His historical revisionism aside, Herzallah should realize that his argument is a two-way street. If advocating for the dissolution of Israel is \u201con the table\u201d in the spirit of free speech, then so is pointing out the anti-Jewish\u00a0double standard<\/a>\u00a0behind it.<\/p>\n

But that, of course, is the entire point: The IHRA working definition\u2014no matter how much its opponents argue otherwise\u2014does not impinge on the rights of free speech. The IHRA website even\u00a0describes<\/a>\u00a0the definition as \u201cnon-legally binding\u201d and specifies that \u201ccriticism of Israel similar to that leveled against any other country cannot be regarded as anti-Semitic.\u201d<\/p>\n

“IfNotNow may purport<\/a> to ‘stand up for the freedom and dignity for all Israelis and Palestinians,’ but its embrace of AMP suggests otherwise.”<\/p><\/blockquote>\n

Astoundingly, this didn\u2019t stop the event\u2019s speakers from falsely asserting on multiple occasions that the IHRA definition and its advocates aim to \u201ccriminalize\u201d the BDS movement that targets Israel. Indeed, this strawman argument was a recurring theme; one speaker\u2019s presentation even featured a slide that insisted that the definition \u201chas been used to,\u201d among other things, \u201csquash free speech.\u201d The slide provided no examples to back up the claims, although a speaker did at one point decry the Trump administration\u2019s 2019\u00a0executive order<\/a>\u00a0affording Jews protections under Title VI of the Civil Rights Act as an attack on freedoms.<\/p>\n

Such fears are unfounded. The\u00a0order<\/a>\u00a0clarifies that those enforcing Title VI should consider the IHRA definition when \u201cidentifying evidence of\u00a0discrimination<\/em>\u00a0based on race, color or national origin\u201d (emphasis added) and \u201cnot diminish or infringe upon any right protected under Federal law or under the First Amendment.\u201d As the Anti-Defamation League has\u00a0explained<\/a>, \u201cUnder the order, criticism of Israel may be considered protected speech, but the line must be drawn when such expression becomes intentional, unlawful, discriminatory intimidation and harassment.\u201d<\/p>\n

Speakers, including an activist with the U.K.-based IfNotNow-equivalent\u00a0Na\u2019amod<\/a>, expressed similar concerns regarding British domestic politics. The approach was equally distorted. At multiple institutions, including the University of Cambridge, the adoption of the IHRA definition has been accompanied by explicit affirmations of the commitment to freedom of speech and inquiry. Even\u00a0Page 16<\/a>\u00a0of the \u201cLegal Guide for Palestine Solidarity Student Activists\u201d itself acknowledges that there is no known case of any university directly citing the IHRA definition to close down an event that is legitimately critical of Israel and is therefore not anti-Semitic in the proper sense of manifesting hatred, discrimination or prejudice towards Jewish people.<\/p>\n

Moreover, British law has never provided a right to freedom of expression akin to the First Amendment. The Human Rights Act (1998), the Communications Act (2008) and the Public Order Act (1986), just to name a few, all provide extensive limits on freedom of expression for a number of purposes, including criminalizing forms of racial and religious discrimination.<\/p>\n

However, it\u2019s clear that what IfNotNow and its allies\u00a0really\u00a0<\/em>fear is the potential to \u201cuse\u201d the IHRA definition to silence pro-Palestinian advocacy or anti-Zionist speech. During his speech, Herzallah alleged that government affairs director of the Simon Wiesenthal Center, Mark Weitzman, helped draft the definition exclusively to silence the BDS movement and criticism of Israel. But just because a definition of bigotry\u00a0can be\u00a0<\/em>misused<\/a>\u00a0to silence speech doesn\u2019t mean the definition itself is wrong. Any attempt to define bigotry, whether or not it involves Israel, is an attempt to marginalize certain hateful ideas and expressions.<\/p>\n

For IfNotNow and its allies, the IHRA definition\u2019s acknowledgment of the connection between anti-Zionism and anti-Semitism likely hits too close to home, hence their crusade to smear it by any means necessary. Prominent Jewish organizations that publicly support the IHRA definition were not even spared IfNotNow\u2019s ire during the event\u2014their\u00a0efforts<\/a>\u00a0to stand up for Israel and Jewish college students slurred as \u201cout of step with reality\u201d and a distraction from the fight against right-wing anti-Semitism (as if countering anti-Semitism is a zero-sum game). It was even suggested that longtime ADL national director Abe Foxman and renowned Holocaust scholar Deborah Lipstadt are \u201cconfused about what anti-Semitism is [and] where it comes from,\u201d a particularly rich accusation from an organization that has\u00a0accused<\/a>\u00a0an American congressman of \u201cpandering to Jews\u201d and that\u00a0vows<\/a>\u00a0to \u201cdefeat\u201d the \u201cJewish establishment.\u201d<\/p>\n

All who value the safety, security and prosperity of Israel should recognize that the widespread campaign against the IHRA definition is merely the latest development in the ideological war against the country\u2019s right to exist. Because the definition affirms that advocacy for stripping the Jewish people of self-determination is anti-Semitic, proponents of this discriminatory goal counter by dishonestly presenting their ideas as a fight for justice. In the process, they denounce the \u201ccriminalization of BDS\u201d that doesn\u2019t exist and slander Jewish organizations astute enough to recognize that the demonization of Israel too often leads to the demonization of Jews.<\/p>\n

We should not let these dangerous efforts go unchallenged.<\/p>\n
