The American Jewish community was shocked this past September, when the San Francisco State University (SFSU) Arab and Muslim Ethnicities and Diaspora Studies program, in conjunction with the SFSU Women and Gender Studies Department, announced\u00a0<a href=\"https:\/\/issuu.com\/spartandaily\/docs\/sd100120all\">their latest event<\/a>: a lecture (via Zoom) with none other than Leila Khaled, who\u00a0<a href=\"https:\/\/issuu.com\/spartandaily\/docs\/sd100120all\">planned to discuss<\/a>\u00a0her experiences both as a \u201cmilitant\u201d and as a \u201cfeminist.\u201d<\/p>\n<p>This stirred controversy because Khaled is a\u00a0<a href=\"https:\/\/www.adl.org\/blog\/leila-khaled-in-her-own-words\">longtime leader<\/a>\u00a0of the Popular Front for the Liberation of Palestine \u2014\u00a0<a href=\"https:\/\/www.state.gov\/foreign-terrorist-organizations\/\">a U.S. State Department-designated foreign terrorist organization<\/a>\u00a0\u2014 and because of her active role in the armed hijacking of two civilian airliners. During her 1970 hijacking of\u00a0<a href=\"https:\/\/www.jweekly.com\/2020\/09\/16\/el-al-pilots-harrowing-tale-of-outmaneuvering-hijacker-invited-to-speak-at-s-f-state\/\">El Al Flight 219<\/a>, she\u00a0<a href=\"https:\/\/camera-uk.org\/2013\/10\/24\/bbc-r4-gives-a-platform-to-terrorist-leila-khaled\/\">attempted to<\/a>\u00a0blow up the plane with a hand grenade, though an air marshal and passenger neutralized it after finding the pin. Her accomplice was killed after shooting a member of the flight crew.<\/p>\n<p>The Lawfare Project \u2014 a\u00a0<a href=\"https:\/\/www.thelawfareproject.org\/who-we-are\">legal organization that<\/a>\u00a0\u201c[defends] the civil and human rights of the Jewish people\u201d \u2014 immediately argued that SFSU\u2019s planned event ran afoul of federal law. Their\u00a0<a href=\"https:\/\/www.dropbox.com\/s\/0g0y3bzuakxl8l0\/LP_Letter_to_Zoom_re_SFSU_2020_09_14.pdf?dl=0\">legal arguments<\/a>\u00a0seem to have succeeded; prior to the event, Zoom\u00a0<a href=\"https:\/\/www.jweekly.com\/2020\/09\/22\/after-protest-zoom-will-not-host-s-f-state-event-featuring-leila-khaled\/\">announced<\/a>\u00a0that it would not host the event on its platform, citing U.S. federal anti-terrorism laws. Nevertheless, Khaled was later scheduled to speak via Zoom under the purview of\u00a0<a href=\"https:\/\/www.facebook.com\/events\/1879089668912466\/\">University of Hawai\u2019i at M\u0101noa (UH)<\/a>-affiliated activist groups. The hosts met the same result as those at SFSU.<\/p>\n<p>So, where does this leave us? To start, many self-described \u201canti-Zionist\u201d activists who support Khaled claim their narrative is being \u201ccensored.\u201d These activists should pick a different hill to die on, considering the potential negative legal implications.<\/p>\n<p>The Lawfare Project argues that Zoom events that host Khaled\u00a0<a href=\"https:\/\/www.thelawfareproject.org\/releases\/2020\/9\/22\/victory-lawfare-project-and-endjewhatred-movement-cause-zoom-to-cancel-leila-khaled-webinar\">violate 18 U.S.C. \u00a7 2339B<\/a>. This\u00a0<a href=\"https:\/\/www.govinfo.gov\/app\/details\/USCODE-2010-title18\/USCODE-2010-title18-partI-chap113B-sec2339B\/summary\">statute<\/a>, cited in The Lawfare Project\u2019s\u00a0<a href=\"https:\/\/www.dropbox.com\/s\/0g0y3bzuakxl8l0\/LP_Letter_to_Zoom_re_SFSU_2020_09_14.pdf?dl=0\">letter<\/a>\u00a0to Zoom\u2019s CEO, Eric Yuan, prohibits providing \u201cmaterial support or resources\u201d to designated foreign terrorist organizations. 18 U.S.C. \u00a7 2339A\u00a0<a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/18\/2339A\">defines<\/a>\u00a0\u201cmaterial support\u201d as:<\/p>\n<p>\u201c\u2026any property, tangible or intangible, or service, including currency or monetary instruments or financial securities, financial services, lodging, training, expert advice or assistance, safehouses, false documentation or identification, communications equipment, facilities, weapons, lethal substances, explosives, personnel (1 or more individuals who may be or include oneself), and transportation, except medicine or religious materials[.]\u201d<\/p>\n<p>Furthermore, as The Lawfare Project\u2019s letter\u00a0<a href=\"https:\/\/www.dropbox.com\/s\/0g0y3bzuakxl8l0\/LP_Letter_to_Zoom_re_SFSU_2020_09_14.pdf?dl=0\">argues<\/a>, the U.S. Supreme Court ruled in\u00a0<a href=\"https:\/\/www.supremecourt.gov\/opinions\/09pdf\/08-1498.pdf\">Holder v. Humanitarian Law Project<\/a>\u00a0that \u201cmaterial support includes \u2018advocacy performed in coordination with, or at the direction of, a foreign terrorist organization.\u2019\u201d<\/p>\n<p>The court clarified that even material support meant to \u201cpromote peaceable, lawful conduct\u201d can further terrorism. The Lawfare Project makes the argument that Zoom\u2019s video conferencing service constitutes a \u201cservice\u201d encompassed by 18 U.S.C. \u00a7 2339B. Furthermore, per The Lawfare Project\u2019s argument, such a \u201cservice\u201d would have been provided \u201cknowingly,\u201d as the organization sent its letter to Zoom nine days before the event at SFSU was scheduled.<\/p>\n<p>At least one member of the U.S. Congress interprets the law similarly; Representative Doug Lamborn (R-CO) submitted a\u00a0<a href=\"https:\/\/lamborn.house.gov\/sites\/lamborn.house.gov\/files\/Rep.%20Lamborn_letter%20to%20DOJ-FBI_SFSU.pdf\">letter<\/a>\u00a0to the U.S. Attorney General William Barr and FBI Director Christopher Wray following the planned SFSU event. In it, he requested an investigation into SFSU, SFSU\u2019s president and the hosts of the event for possible violations of the same laws prohibiting material support for terrorism. The congressman used arguments virtually indistinguishable from those of The Lawfare Project.<\/p>\n<blockquote><p>&#8220;The court clarified that even material support meant to &#8216;promote peaceable, lawful conduct&#8217; can further terrorism.&#8221;<\/p><\/blockquote>\n<p>When it comes to tech companies\u2019 efforts to bar Khaled from their platforms, The Lawfare Project is understandably pleased. When asked for comment, Chief Operating Officer and Director of Research at The Lawfare Project Benjamin Ryberg told the Daily Nexus, \u201cWe were encouraged by the receptivity of the top legal professionals at Zoom and Google, and applaud them for acting swiftly and decisively to avoid the unlawful provision of their platforms to a terrorist. It is incumbent on campus officials to take the relevant legal implications just as seriously, and make it abundantly clear to students and faculty that similar attempts to host terrorists will be obstructed.\u201d<\/p>\n<p>All of this raises the question, what are the potential legal consequences for such conduct? The law, in part, states that violators shall be fined, imprisoned up to twenty years or both, barring that no one is killed as a result. But then, one might ask, why should the average university student care if they had nothing to do with organizing the event? In a separate\u00a0<a href=\"https:\/\/lamborn.house.gov\/sites\/lamborn.house.gov\/files\/Rep.%20Lamborn_Letter%20to%20Sec.%20DeVos_SFSU.pdf\">letter<\/a>\u00a0to Secretary of Education Betsy DeVos and Treasury Secretary Steven Mnuchin, Lamborn calls for a hold on all federal funding to SFSU, a public university, due to his belief that counterterrorism laws were violated. (Secretary DeVos is\u00a0<a href=\"https:\/\/twitter.com\/RepDLamborn\/status\/1324787184810020869\">following up<\/a>\u00a0on the matter.) If these recent events do result in legal consequences or slashes in federal funding, the precedent would be set; any public university, including UCSB, could face a similar fate if its staff plans a similar event.<\/p>\n<p>In summary, platforming a terrorist who has attempted to murder civilians in the name of the destruction of Israel could present serious legal ramifications to other universities who choose to do the same.
