Linking Black Lives Matter to Israeli affairs is inaccurate and dishonest.<\/h2>\n

On Oct. 8, the\u00a0Jewish News<\/em>\u00a0online\u00a0published an op-ed<\/a>\u00a0by IfNotNow Detroit activists Rebecca Driker-Ohren and Zak Witus titled \u201cPalestinian Lives Matter.<\/em>\u201d Of course, Palestinian lives matter \u00a0\u2014 that is not in dispute.<\/p>\n

What one\u00a0can\u00a0<\/em>dispute is Driker-Ohren and Witus\u2019 conflation of one-sided denunciation of Israel with the movement for racial justice in the United States. Indeed, the authors seem to believe that the Metro Detroit Jewish community\u2019s alleged reluctance to sufficiently admonish Israel renders its leaders nothing more than moral hypocrites.<\/p>\n

As Driker-Ohren and Witus describe it, \u201cWe in the anti-occupation movement were left questioning whether this enthusiasm for [Black Lives Matter], with its attendant principles of universal equality and freedom, would extend to the arena of Israel\/Palestine.\u201d<\/p>\n

To the authors, the fight for \u201cuniversal equality and freedom\u201d seems to necessitate myopic and context-free censure of Israel. Unfortunately, the piece employs myriad falsehoods to make its case.<\/p>\n

Misrepresenting \u201cannexation\u201d<\/strong><\/p>\n

Driker-Ohren and Witus open their arguments by touting an\u00a0IfNotNow-led protest<\/a>\u00a0against \u201cthe Trump-Netanyahu plan to formalize Israeli annexation of more Palestinian lands on the occupied West Bank\u201d outside the Jewish Federation of Metropolitan Detroit\u2019s headquarters, as if an American Jewish institution is obligated to endorse IfNotNow\u2019s positions regarding territorial disputes. They describe such \u201cannexation\u201d as a \u201cflagrant violation\u201d of international law.<\/p>\n

However, this is an erroneous premise: There are persuasive legal arguments in favor of an Israeli extension of sovereignty within certain areas of the territory.<\/p>\n

As the international law scholar Eugene Kontorovich\u00a0points out<\/a>, the\u00a0International Court of Justice-affirmed principal<\/a>\u00a0of\u00a0uti possidetis juris\u00a0<\/em>(\u201cyou possess under law\u201d) posits that \u201cWhen new countries emerge from old ones or from colonial empires, the last official international borders constitute the new boundary lines.\u201d After the British relinquished control of the land between the Jordan River and the Mediterranean Sea, Israel was the state that declared independence within that geographical area\u00a0without specifying its borders<\/a>.<\/p>\n

Therefore, per Kontorovich\u2019s reasoning, Israel has substantive territorial claims in the West Bank. There is plenty of precedence for this: Jordan\u2019s and Iraq\u2019s internationally-recognized borders, for example, are based on colonial-era Mandatory administrative divisions.<\/p>\n

The territory within the\u00a0armistice line<\/a>\u00a0established after Jordan\u2019s 1948 invasion of Israel now known as the West Bank has never been\u00a0wholly<\/em>\u00a0controlled by a Palestinian Arab political entity. The limited Palestinian self-governance within certain areas of the West Bank established after the 1990s Oslo peace process\u00a0marked<\/a>\u00a0the first such instance in history, and the areas eyed by the Israeli government for an extension of sovereignty\u00a0lie within<\/a>\u00a0\u201cArea C\u201d of the West Bank, which Israel controls, in accordance with the Oslo Accords. That means that Israel would not be illegally \u201cannexing\u201d the territory of a\u00a0foreign sovereign country<\/a>.<\/p>\n

Painting Israel as an apartheid state<\/strong><\/p>\n

Driker-Ohren and Witus go on to detail their desire to end Israeli \u201coccupation,\u201d also described as \u201chafrada<\/em>\u201d (Hebrew for \u201cseparation\u201d). In case the metaphor was unclear, they clarify that \u201cIt is no accident that the meaning of this Hebrew word resembles the Afrikaans word \u2018apartheid\u2019\u2026\u201d We are to believe that this system \u201cneeds racism and militarism in order to function,\u201d and that the \u201coccupation\u201d \u201cdenies Palestinians freedom and dignity by depriving them of civil, political and economic rights.\u201d<\/p>\n

An uneducated reader of Driker-Ohren and Witus\u2019s piece would have no idea that the vast majority of the West Bank\u2019s Palestinian Arabs live under the purview of the Palestinian Authority, and that the Gaza Strip is ruled by the\u00a0U.S.-designated terrorist organization<\/a>\u00a0Hamas. If Palestinians are denied their \u201cfreedom and dignity\u201d and \u201ccivil, political and economic rights,\u201d wouldn\u2019t the bulk of the blame fall on their own rulers?<\/p>\n

In any case, Israelis (whether Jewish or Arab) and Palestinians live under separate political entities. In no way does this constitute apartheid. There are multiple territorial arrangements around the world in which separate political entities share a piece of land; for example, Lesotho is an entirely independent state surrounded by South Africa, as is San Marino within Italy. (While it\u2019s true that Palestinian rulers exercise limited self-rule, as opposed to full statehood, the point is that it\u2019s not \u201capartheid\u201d-esque to separate peoples based on national citizenship.)<\/p>\n

Israel\u2019s security apparatus within the West Bank and blockade of the Gaza Strip are not in place to impose racial hegemony, but to protect Israeli citizens against\u00a0stabbing attacks<\/a>,\u00a0car-rammings<\/a>,\u00a0rocket attacks<\/a>,\u00a0suicide bombings<\/a>\u00a0and other terrorist assaults. To ignore this context, as Driker-Ohren and Witus do, is dishonest.<\/p>\n

Settlements and the Movement for Black Lives<\/strong><\/p>\n

Another glaring contradiction stands out: the authors reassure us that IfNotNow \u201caffirms the right of Jewish Israelis to live in the land with freedom and dignity, just as [they] affirm the same right for Palestinians.\u201d Yet, they also laud poll results that indicate increasing support for evacuating \u201cJewish-only settlements in the West Bank\u201d among American Jews, ostensibly to achieve a two-state solution (the settlements are not<\/a>\u00a0\u201cJewish-only\u201d).<\/p>\n

But if all should be free to live in the land with \u201cfreedom and dignity,\u201d why do Jewish-majority areas in the West Bank need to be evacuated? Why couldn\u2019t \u2014 theoretically \u2014 Jews live as a minority in a future Palestinian state just as Arabs live as a minority in the Jewish state? Perhaps it would be possible if Palestinian Authority President Mahmoud Abbas didn\u2019t\u00a0insist<\/a>, \u201cIn a final resolution, we would not see the presence of a single Israeli \u2014 civilian or soldier \u2014 on our lands.\u201d<\/p>\n

Driker-Ohren and Witus also incorrectly state that past Jewish criticism of the Movement for Black Lives platform was based on its supposed \u201c[alignment] with the Palestinian freedom movement \u2026\u201d In reality, the Jewish community\u00a0objected<\/a>\u00a0to the platform\u2019s\u00a0entirely false assertion<\/a>\u00a0that Israel is committing \u201cgenocide\u201d against the Palestinians, and the\u00a0equally absurd canard<\/a>\u00a0that Israel practices \u201capartheid.\u201d<\/p>\n

Entirely Different Issues<\/strong><\/p>\n

America is not the Levant; the national conflict between the Israelis and the Palestinians is an entirely different geopolitical issue than racial tension in America. As CAMERA UK\u2019s Adam Levick\u00a0puts it<\/a>, \u201cthe [Israeli-Palestinian] conflict in general, and the occupation of disputed land in particular, isn\u2019t fueled by race, but by the failure of two people to reach a political agreement on how to share the land.\u201d<\/p>\n

In large part, these two peoples have failed to reach a political agreement because of Palestinian leaders\u2019\u00a0unwillingness to accept<\/a>\u00a0a Jewish state in any part of the land between the river and the sea and\u00a0repeated rejections<\/a>\u00a0of peace agreements. Hamas officials\u00a0assert<\/a>\u00a0that \u201cthe Jews have filled the land of Palestine with corruption\u201d and that \u201cAllah said that [Jews] are \u2018the worst of living creatures in the sight of Allah\u2019\u201d \u2014 the group\u2019s\u00a0founding charter<\/a>\u00a0proudly glorifies the murder of Jews, and they have orchestrated countless terror attacks within Israel, including suicide bombings.<\/p>\n

The \u201cmoderate\u201d Palestinian Authority grants\u00a0hundreds of thousands of dollars<\/a>\u00a0to those who kill Israelis in terror attacks, and\u00a0deems land sales<\/a>\u00a0to Jews \u201chigh treason,\u201d which is punishable by death. According to Israel\u2019s\u00a0Ministry of Foreign Affairs<\/a>, \u201c1,360 people have been killed by Palestinian violence and terrorism since September 2000.\u201d<\/p>\n

Accordingly, many Israelis (understandably) fear that \u201cending the occupation\u201d of the West Bank would invite a Hamas takeover of the territory\u00a0as it did in Gaza<\/a>\u00a0following Israel\u2019s 2005 withdrawal from the area. If that happened, Hamas would gain access to the Judaean hills \u2014 high ground that provides a perfect vantage point to launch rockets into the heart of Israel\u2019s densest cities. Such a situation would likely lead to further Israeli efforts to defend its citizens, thus worsening Palestinian life.<\/p>\n

Driker-Ohren and Witus do not consider this in their piece. In fact, the piece doesn\u2019t acknowledge\u00a0any\u00a0<\/em>Israeli security concerns, likely because doing so belies the superficial caricaturizing of Israel\u2019s actions as unjustifiably militaristic and \u201cracist.\u201d<\/p>\n

Any analysis that characterizes this conflict as an Israeli Goliath mercilessly oppressing a Palestinian David does not tell the whole story. Sadly, it seems that Driker-Ohren and Witus would like acceptance of such a narrative to become a \u201cprogressive\u201d value within the Jewish community.<\/p>\n
